By accessing or using QuestGo ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including organizations that register to create quests ("Organizers") and individuals who participate in quests ("Participants").
QuestGo is a geolocation-based discovery and scavenger hunt platform that enables organizations to create location-based quests with check-in points, progress tracking, and digital rewards. The Platform serves as an intermediary between Organizers who create content and Participants who engage with that content.
The Platform allows Organizers to upload, post, submit, or otherwise make available content including but not limited to text, images, quest descriptions, checkpoint information, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Platform.
By submitting User Content, you grant QuestGo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and improving the Platform.
You represent and warrant that: (a) you own or have the necessary rights to all User Content you submit; (b) your User Content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights; and (c) your User Content complies with all applicable laws and regulations.
QuestGo respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, QuestGo has implemented a policy for addressing claims of copyright infringement.
Notice of Infringement: If you believe that content available on or through the Platform infringes one or more of your copyrights, please submit a written notice ("DMCA Notice") to our designated copyright agent containing the following information:

QuestGo will respond to valid DMCA Notices by removing or disabling access to the allegedly infringing content. QuestGo reserves the right to terminate accounts of repeat infringers.
QuestGo involves physical movement in real-world locations. You are solely responsible for your own safety and the safety of anyone accompanying you during quest participation. Always be aware of your surroundings, obey traffic laws, and respect property boundaries. Do not use QuestGo while driving or operating machinery.
QuestGo is not responsible for any injury, property damage, or loss that occurs during quest participation. Quest organizers are responsible for ensuring their quest locations are safe, legally accessible, and appropriate for their intended audience.
Organizations wishing to create quests on the Platform must register and receive approval from QuestGo. Registration does not guarantee approval. QuestGo reserves the right to approve or deny any organization registration at its sole discretion.
Approved organizations are responsible for ensuring that all content they create, including quest descriptions, checkpoint information, and any images or media, complies with these Terms and all applicable laws. Organizations must not create quests that trespass on private property, endanger participants, or violate any local ordinances.
All public quests are subject to review and approval by QuestGo before being listed publicly on the Platform. QuestGo reserves the right to reject, remove, or modify any content that violates these Terms, applicable law, or that QuestGo determines in its sole discretion to be inappropriate, harmful, or objectionable.
QuestGo is not obligated to monitor all content on the Platform but reserves the right to do so. QuestGo does not endorse any User Content and expressly disclaims any and all liability in connection with User Content.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, QUESTGO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. QUESTGO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY USER CONTENT, EVEN IF QUESTGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless QuestGo and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
QuestGo reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of these Terms. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
